Terms and conditions for trading
Please read this Terms and conditions for trading before using service. If you use FGI Online Service (FGI Web Shop), you will be bound by the terms and conditions of the Agreement.
1. The service
The FGI Web Shop permits you (the Purchaser) to purchase goods and/or services from FGI d.o.o. or its Affiliates (the Seller) under terms and conditions as set forth in this Agreement.
2. Product
Seller sells and distributes products under FRESTYLER or similar trademark and the Purchase buys and pays products under FRESTYLER or similar trademark.Each product that is sold by Seller is described on FGI Web Shop.
3. Price and payment conditions
Product is sold for the price that is published by each product. Price does not include VAT. Advance payment is required, if not agreed otherwise.
4. Ordering
Agreement is concluded when Purchaser orders product.
5. Place of delivery
Product shall be delivered to delivery place named in Purchaser's order.
6. Delivery time
Sellers takes over obligation that product shall be delivered to agreed place within 14 working days after Agreement was concluded.
7. Transportation
Transportation cost shall be born by Purchaser. Risk of loss of the product and/or risk of damage the product passes to Purchaser upon delivery of product to the carrier.
8. Sellers Liability and Limitation of Liability
Seller shall not be liable for any damages occurred to Purchaser or third parties by the Product, if Product is not used in accordance with Sellers instructions. Subject to Condition 9 (of this Terms and Conditions), and notwithstanding anything contained in these Conditions (other than Condition 9) or the Order, the Seller’s liability to the Purchaser in respect of the Order, in contract, tort (including negligence or breach of statutory duty) or howsoever otherwise arising, shall be limited to 100% of the price of the goods specified in the Order.
9. Guarantees
For products which are sold by the Seller, the Seller grants the following guarantee: The Seller shall, free of charge, either repair or, at its option, replace defective goods where the defects appear under proper use within 12 months from the date of delivery, provided that:
- notice in writing of the defects complained of shall be given to the Seller upon their appearance; and
- such defects shall be found to the Seller’s reasonable satisfaction to have arisen from the Seller’s faulty design, workmanship or materials; and
- the defective goods shall be returned to the Seller’s premises at the purchaser’s expense if so requested by the Seller.
Any repaired or replaced goods shall be redelivered by the Seller free of charge to the original point of delivery but otherwise in accordance with and subject to these Conditions of Warranty [save that the period of 12 months referred to in first Paragraph of this Article shall be replaced by the unexpired portion of that period only].
Alternatively to first Paragraph of this Article, the Seller shall be entitled at its absolute discretion to refund the price of the defective goods in the event that such price shall already have been paid by the Purchaser to the Seller.
The Seller’s liability shall be to the exclusion of all other liability to the Purchaser whether contractual, tortious or otherwise for defects in the goods or for any loss or damage to or caused by the goods, warranties, stipulations or other statements whatsoever concerning the goods, whether express or implied, by statute, at common law or otherwise howsoever, are hereby excluded; in particular (but without limitation of the foregoing) the Seller grants no warranties regarding the fitness for purpose, performance, use, nature or quality of the goods, whether express or implied, by statute, at common law or otherwise howsoever.
10. Applicable law
The Order shall be considered a contract made in Republic of Slovenia and shall be governed in all respects by the law of Republic of Slovenia.
11. Disputes
Any dispute relating in any way to your visit to FGI Web Shop or to products or services sold or distributed by FGI d.o.ol. or through FGI.com shall be adjudicated to court in Ljubljana, Republic of Slovenia, and you consent to exclusive jurisdiction and venue of this court.
